TERMS AND CONDITIONS OF USE OF THE WEBSITE AND PROVISION OF SERVICES Rose & Wine Beauty SPA
1. General Provisions
1.1. These Terms and Conditions define the rules for using the website operated by Rose & Wine Beauty SPA and the rules for providing massage services. 1.2. The website administrator and service provider is Grupa Sherlook Sp. z o.o., with its registered office in Warsaw, at 2A/208 Ludna Street, 00-406 Warsaw, entered into the National Court Register under KRS number: 0000927196, Tax Identification Number (NIP): 5252884975, National Business Registry Number (REGON): 520480888. 1.3. These Terms and Conditions have been prepared in accordance with the provisions of the law of the Republic of Poland, in particular the Civil Code, the Act of 18 July 2002 on the provision of services by electronic means, the Act of 30 May 2014 on consumer rights, and the provisions of the GDPR. 1.4. By accessing the website, reviewing its content, or using the services, you accept these Terms and Conditions. 1.5. The information provided on the website is for informational and advertising purposes only.
2. Definitions
For the purposes of these Terms and Conditions, the following terms shall mean:
- Client – an natural person using the services of Rose & Wine Beauty SPA;
- Services – professional massage services provided by Rose & Wine Beauty SPA;
- Website – the website operated at rosewine.pl;
- Terms and Conditions – this document;
- Data Controller – Grupa Sherlook Sp. z o.o.
3. Scope and Nature of the Services Provided
3.1. Rose & Wine Beauty SPA provides only professional and legal massage services, in particular: classic massage, relaxing massage, tantric massage, and body-to-body massage.
3.2. The services are intended for relaxation, wellness, and stress relief purposes; however, they do not replace medical consultations or treatment.
3.3. Rose & Wine Beauty SPA under no circumstances offers, promotes, mediates, or allows the use of services of a sexual nature or prostitution. Requesting such services is strictly prohibited and will result in the immediate termination of the session without any refund.
3.4. Each session is conducted exclusively within the scope of the services offered.
4. Terms of Service Use
4.1. Z Services are available exclusively to adults (18+).
4.2. The Client is obliged to:
- provide accurate contact information when making a reservation,
- arrive punctually for the scheduled session,
- maintain personal decorum and respect for the staff,
- respect the personal boundaries of the masseurs,
- inform about any health contraindications before the session begins.
4.3. The Client agrees to refrain from:
- making sexual proposals,
- engaging in inappropriate behavior,
- violating the personal integrity of the staff.
4.4. In the event of a breach of the above rules, the staff member has the right to terminate the service immediately, without any obligation to refund the payment.
5. Rights and Obligations of the Staff and Company Liability
5.1. The staff provide services strictly in accordance with professional ethics and within the limits of these Terms and Conditions.
5.2. The staff have the right to refuse or terminate the service if the client violates the Terms and Conditions.
5.3. Rose & Wine Beauty SPA is not liable for damages resulting from:
- the client’s failure to disclose health contraindications for the massage,
- the client’s actions that violate the Terms and Conditions,
- situations arising from force majeure.
5.4. The client is liable for any damage caused to the company’s property or to third parties on the premises.
6. Reservations, Payments, and Withdrawal from the Agreement
6.1. Reservations can be made via the website, by phone, or in person.
6.2. Payment for the service can be made in cash or by any other method accepted by the company.
6.3. The client has the right to withdraw from the agreement (cancel the reservation) no later than 24 hours before the scheduled appointment.
6.4. In the event of cancellation less than 24 hours before the appointment or the client’s no-show, Rose & Wine Beauty SPA reserves the right to charge the full fee for the service.
7. Complaints
7.1. The client has the right to submit a complaint within 14 days from the date the service was provided.
7.2. Complaints can be submitted by email to: kontakt@rosewine.pl.
7.3. The complaint will be processed within 14 calendar days, and a response will be provided electronically or in writing.
7.4. If the complaint is accepted, the company will offer the client compensation in the form of a partial or full refund or a repeat of the service.
8. Provision of Services by Electronic Means
8.1. The website provides electronic services, such as a contact form, reservation form, and submission of inquiries.
8.2. To use the website, the following are required: a device with Internet access, an up-to-date web browser, and an active email address.
8.3. The client agrees not to submit unlawful content or engage in actions that disrupt the functioning of the website.
9. Privacy Policy and Personal Data
9.1. The administrator of personal data is Rose & Wine Beauty SPA ((Grupa Sherlook Sp. z o.o.).
9.2. Personal data is processed in accordance with the GDPR, solely for the purpose of providing services and customer support.
9.3. The client has the right to:
- access their personal data,
- rectify, delete, or restrict the processing of their data,
- object to the processing of their data,
- data portability,
- file a complaint with the President of the Personal Data Protection Office (UODO).
9.4. Clients’ data is not shared with third parties, except as required by law.
10. Legal Disclaimers
10.1. Rose & Wine Beauty SPA emphasizes that all content on the website is for informational and promotional purposes only.
10.2. The company reserves the right to pursue legal claims in the event of defamation, damage to reputation, publication of false information, or violation of the Terms and Conditions.
10.3. Any disputes will be resolved by the common courts competent for the company’s registered office.
10.4. A client who is a consumer has the option to use out-of-court methods for resolving complaints and claims, in particular before the Permanent Consumer Arbitration Courts at the Regional Inspectorates of the Trade Inspection.
11. Severability Clause
11.1. If any provision of these Regulations is deemed invalid, the remaining provisions shall remain in force and shall bind the parties.
12. Final provisions
12.1. These Regulations come into effect on the date of publication on the website.
12.2. The Company reserves the right to change the Regulations at any time without prior notice to customers.
12.3. In matters not regulated herein, the provisions of Polish law shall apply, in particular the Civil Code.
